Intellectual Property (“IP”) protection essentially aims to reward inventors, creators, and producers for their hard work and investments. Yet, we must also ensure healthy competition and public access, avoiding monopolies, especially in global trade. In the bid to strike this balance, principles like parallel importation and the doctrine of exhaustion have emerged.

In this paper, we delve into the anti-restrictive impact of the FCCPA on IP rights owners in Nigeria.
